Terms & Conditions
If you hire me to write for you, please confirm that you accept the following terms and conditions. These are intended solely to prevent misunderstandings and establish what has been agreed to in the unlikely event of a dispute.
Confirmation of the contract
Before work begins, I will require your written confirmation, either by email or letter, stating clearly that you are commissioning me to write for you and that you accept the agreed fee. If you wish to commission me to work for you on behalf of an organisation or company other than yourself, or your own company, you confirm that you are authorised to do so.
The contract
A contract will exist only between me and you (or your organisation), not between me and any third party. You agree to indemnify me against any claim for compensation or damages brought about as a direct or indirect consequence of any work I do for you or your organisation.
The agreed fee
The agreed fee will cover correspondence regarding your brief and writing and submission of the first draft. If you are not entirely happy with the first draft, upon further discussion and feedback, I will happily rewrite and submit up to two sets of revisions for no extra charge. The agreed fee is based on the original brief. Please note that if any significant changes or additions are made to this brief, I may request a further fee for any revisions. In the event of this, I will notify you in advance and will commence work when an additional fee has been agreed.
Non–disclosure and confidentiality agreements
If required to, I will be happy to sign any confidentiality and non-disclosure agreement. However, upon me doing so, you agree to indemnify me for any claim for compensation or damages as a result of accidental disclosure or loss of information.
Your satisfaction
Creative writing is subjective. If, for whatever reason, you are not entirely happy with any part of the work I submit to you, please inform me and I will do my best to address your concerns. If, after reasonable discussion and clear confirmation of your requirements, you are still not happy with the final submission, the contract between us will be cancelled and no payment will be due. This will exclude any deposit that has been paid at the outset. Deposits to secure work will not be refunded. In such a circumstance, I imply no liability, or admission of failure or inability to complete a contract, on my part. I will retain the copyright for everything I have written and this shall not be used by you or any third party. If any part of the submitted work is used, the agreed fee will become payable in full. You also agree that I am absolved of all responsibility for any loss of income, or for any cost or damages, suffered by you or by any third party as a consequence of any delay.
Payment terms
Upon submission of the first, second or final draft, if I have not received any comments within 5 working days, I will assume that you have accepted the work. Invoices will be sent electronically, unless agreed otherwise and are payable within 7 days of receipt. In circumstances where I request that part of the fee be paid prior to commencement of any work, the
balance of the fee will be payable within 7 days of the final invoice.
Copyright
I will assign copyright of all material I write for you (or your organisation) once I receive full payment of the fee due. I reserve the right to use selected extracts of my work for the purpose of self promotion or advertising, unless, as a prior agreement, I have been specifically asked not to do so. If you supply me with any copyrighted material as part of a brief, you confirm that you are authorised to send me that material for either reference or to form part of a new piece of work. Whilst I will make every effort to not breach any copyright, you agree to indemnify me against any direct or indirect action that may arise as a result of using this content.
Errors
I will make every best effort to proof read and check any work I submit. I cannot however guarantee that all work I submit will be free of any typographical or grammatical or factual errors. You agree to proof read any material I submit to you and indemnify me against any costs that may arise from the appearance of any errors in any printed or published form. Whilst I will do my best to ensure that my work complies with the law, it will be your responsibility to submit all copy for legal review.
